Prevailing Discrimination

Caste-Based Discrimination and Untouchability (offence and Punishment) Act, 2068

Preamble:

"Whereas, acknowledging the principle that each person is equal in terms of rights and human dignity, it is expedient to provide timely provisions to protect the right of each person to live with equality, freedom and human dignity by creating an environment where no untouchability and discrimination prevails on the ground of caste, ethnicity, decent, community or occupation in the name of custom, tradition, culture, ritual or any other name, to make punishable the acts of untouchability, exclusion, restriction expulsion, contempt or any other discriminatory act that is against humanity, to provide restitution (compensation) to the mvictim of such acts, to keep intact the national unity by strengthening the relationship subsisting among the members of the general public, and to create an egalitarian society. "

It's shade for gentleman and heavy load for the lady.

Though it has been clearly defined in this act and various actions are being taken for the enactment of this act, the prevailing condition regarding discrimination on basis of caste, gender, etc. exists in the society as a form of much deeper rooted problem. The result of these discriminatory acts and feelings can though never stay away from hindering the development as well as the creation of peaceful situation, it is not easy to be rooted out.

A 100 day campaign was jointly organized by National Dalit Commission (NDC) and The United Nations Human Rights Office in Nepal (OHCHR-Nepal) from 16 September 2011 to 24 December 2011, there seems to be a need for a 100years campaign to get rid of such a problem.

Basically there exist groups in the society who should be made to realize about the problems that arise for the discriminated. The realization of this critical issue that will certainly change the shape of social formation stays in the remotest part of the country where already the life is hard enough for the fulfillment of basic needs and these discrimination certainly does not make it any more easy. It is not that this problem does not exist in the city area.  Discrimination on various basis exists even in the so called "big organizations" in the form of "glass ceiling" but that does not really create as big a problem as it does in the poor and deprived people of rural parts of Nepal which can be noticed in a short visit to those places as a tourist, student or volunteer in Nepal.

Problems created due to the discrimination are obvious and even a single thought on this topic could lead to mind-boggling and disturbing images, still not forgetting the various cases made worse if not better due to the decade over riots, protest and violence in the country. The cause of these problems can be traced out from the history until the  present day's wrong concepts and unnecessary differences created for the benefits of certain group of people that are realized or unrealized. But now, it is already end of 11th hour to start vigorously acting against this discrimination through conceptualization of a peaceful and prosperous society where culture and traditions are preserved but the ill concepts are rectified.
